Terms

These Terms govern your access to and use of Kensa, the service operated by BORGWARE PTY LTD, trading as Kensa (“Kensa”, “we”, “us”, or “our”), including the web application, API, MCP server, and documentation at kensa.sh (the “Service”). By accessing or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have the authority to bind that organization.
Please also read our Privacy Policy, which explains how we collect, use, and share personal data.
1. The Service
Kensa detects issues from your agents' traces and helps your coding agent fix them. You connect traces from your own agents, Kensa surfaces potential issues grounded in evidence from those traces, and your coding agent reads an issue over MCP to investigate and report a fix. If you connect a GitHub repository, Kensa uses read-only, repository-scoped access to selected files to draft agent job context when you request it.
2. Accounts
You need an account to use most of the Service. You're responsible for the accuracy of the information you give us, for keeping your credentials confidential, and for activity that happens under your account. Tell us promptly if you believe your account or an API key has been compromised.
3. Your content
You retain ownership of the trace data, repository content, and other material you submit to the Service (“Your Content”). You grant us a limited license to host, process, and transmit Your Content as needed to provide, secure, and support the Service, including sending selected portions of it to our model provider to detect issues or draft agent job context. You're responsible for ensuring you have the rights and permissions needed to submit Your Content to us.
We do not use Your Content to train our own models, and our agreements with model providers do not permit them to train on it either.
4. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to derive the source code of the Service, except where applicable law prevents this restriction;
- Probe, scan, or attempt to penetrate the Service, or interfere with its security;
- Use the Service to build or train a competing product, or to scrape or extract data beyond your own account's access;
- Resell, sublicense, or provide third-party access to the Service without our consent;
- Use the Service in a way that infringes any third party's rights or violates applicable law.
5. Issues and suggested fixes
Kensa detects issues using evidence from your traces and, where connected, your repository. You control which changes reach production and are responsible for reviewing and testing them before deployment.
Findings and suggested or reported fixes use automated, model-based analysis and may contain errors, omissions, or incomplete context. After deployment, Kensa monitors incoming traces for recurrence. This monitoring does not verify or guarantee a fix's correctness.
6. Third-party integrations
The Service can connect to third-party tools you choose, such as GitHub and Langfuse. Each integration is operated by its provider, and your use is also governed by that provider's terms. We are not responsible for their availability or behavior.
7. Fees and payment
Some features of the Service may require a paid plan. Where a fee applies, we'll show you the price before you're charged. Unless stated otherwise, fees are billed in advance on a recurring basis and are non-refundable except as required by law. Payment is handled by a third-party payment processor; we do not store your full payment card details, and that processor's own terms apply to the payment information you give it. We'll give you reasonable notice before a fee change takes effect on your account.
8. Changes to the Service
Kensa is under active development. We may add, change, remove, or limit features, and may suspend the Service temporarily for maintenance, without liability to you for those changes.
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms. On termination, we handle Your Content as described in our Privacy Policy.
10. Intellectual property
Kensa and its licensors own the Service and all related intellectual property, excluding Your Content. If you send us feedback or suggestions about the Service, you grant us the right to use them without restriction or compensation to you.
11. Disclaimers
The Service, including any issues it surfaces and any suggested fixes, is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the maximum extent permitted by law, Kensa will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the six months before the claim arose.
13. Changes to these Terms
We may update these Terms from time to time. We'll update the date at the top of this page when we do, and give more prominent notice for changes we consider material. Continuing to use the Service after a change takes effect means you accept the updated Terms.
